Walter Yarosh called the meeting to order at 9:10 a.m.

Building, site and Landscape Plans

Kevin Kirrane, Matt Eddy, Joao Junqueira, and Bob and Dottie Franey appeared. Attorney Kevin
Kirrane addressed the meeting saying:
- A plan was approved for this site in 2008 but owner never developed.
- Property currently owned by Community Bank.
- Bob and Dottie Franey proposing to move their business to this site.
- Site will be serviced by public water supply and will have Title V septic system on the property.
- Use for the building is for medical laboratory and office use and there is some warehouse storage space.
- This is largely a collection facility. Collects urine samplings for testing.
- Very limited amount of walk-in traffic—not intended to be like a C-Lab facility.
- Building will occupy about 8% of the site and provided appropriate buffers and set-back as called for in zoning by-law.
- 22 parking spaces—2 handicap spaces.
Mary LeBlanc asked what the set-back requirements are in this industrial zone. Tom Fudala responded that a minimum of 10 feet buffer set back is required. Matt Eddy commented that they exceeded the 10 foot buffer all the way around.
Matt Eddy identified the plantings in the Landscape Plan. An irrigation well is going to be installed.

Mary LeBlanc stated that from landscaping point of view around the building there is an opportunity for at least one shade tree in each of the parking islands. On the North side, Mary said it would be preferable to see some shade trees back there. For the West easement, Mary suggested they pick native evergreen tree for that area.
Glen Harrington said regarding Septic—on design flow showing office with incidental warehouse. Are employees in the warehouse? Mr. Franey said no employees staying in the warehouse; supplies are being kept there.
Glen advised that the occupancy of the building will be based on the square footage of the laboratory office at whatever the building code says for how much square footage per person is allowed in laboratory/office category.
Site is not Zone 2; abiding by the local 600 gallons/day.
Glen asked…in the urine sampling/testing, any other medications or chemicals going to be used? Matt Eddy said minor quantities/types so that nothing else is required.
George Baker asked if Matt had the turning radius template; Matt responded “yes”.
George Baker asked about the quantity of methanol used…he said he would put them in touch with County Health to see whether it is a reportable limit. If it is a reportable limit, then chem/lock cabinet would be needed. Mr. Farney said they believe they already handled that He said they are restricted by the federal government. Chief Baker said the by-product of the test is to consider is it biologic or septic waste.
Chief Baker asked: Any need for acid tank or other plumbing?
Matt Eddy said it was identified to him that every 3 to 6 months they use approximately one pint of hydrochloric acid; formic acid; methanol; ammonium hydroxide. Chief Baker said the plumbing inspector will want to know and follow-up since it might require an acid trap.
Bob Nelson stated that at a previous ZBA hearing on the site with 4 buildings the only problem ZBA had was that a large turnout of people was at the hearing concerned with what they would be looking at. Joao Junqueira said 100 feet from the property line is going to be cleared so he thinks the neighbors are going to be very happy. Matt Eddy said he, too, believes the neighbors will be much happier with this plan.
Tom Fudala asked if there is some reason only a 20 foot buffer where there is 40 feet of space. Matt Eddy said existing vegetation will be maintained but they wanted to show 20’ buffer since they are planning for future expansion. Mary LeBlanc pointed out there is no grading back there. Kevin Kirrane said they can mark on the plan that the back is not being cleared but they are showing clearing in planning for possible future expansion. Chief Baker pointed out that this is right at the edge of wildlife refuge. He said as this gets into final submission, he suggested they call him and he has literature that identifies which plantings are better than others.
Walter Yarosh asked whether or not the warehouse gets used on a daily function. Mr. Franey said it is more of a garage and storage space for supplies.

Walter said the building works well for the lot. He noted that none of the finishes/colors are labeled on the Plan. Joao Junqueira showed the samples…vinyl shingle is woodland mist; vinyl clapboard is granite grey. Wood trusses on the roof.
There was no lighting Plan. Walter said lighting cannot leave property line according to by-law. Matt Eddy said they are not doing lighting at the back. Walter suggested when they go to Board of Appeals they should take a lighting Plan to BOA that shows it does not exceed their property line.
Mary LeBlanc asked: How are you dealing with drainage swells? Matt Eddy said planting schedule was submitted showing that. Matt explained run-off handling. Glen Harrington said when they come to the Board of Health with site Plan they will go over that. Glen questioned 4 bay usage because he said there is ability for water to pond there.
Glen said when they come to Board of Health for septic approval, they are required to have an annual contract to maintain the retention areas.
Chief Baker said Fire Department and Building Department will have to look at usage. He said applicant’s architect will have to select a hazard class…that will determine whether to be sprinkled or not.
Richard Morgan said they should bear in mind the amount of the use and what you can store.
Design Review
Motion: David Kooharian motioned Design Review approves as discussed; Mary LeBlanc seconded the motion; and the motion was unanimously passed by Design Review.
Plan Review
Motion: Tom Fudala motioned Plan Review approves with the conditions:
- Leave rear buffer at this point as much as possible—maybe 40 feet;
- Annual contract to maintain bio-retention areas;
- Plan to show building finishes and colors;
- Lighting Plan to be submitted;
- Photometric Plan;
- Hazardous materials review through County Health.
Glen Harrington seconded the motion; and the motion was unanimously passed by Plan Review.

Matt Flynn appeared since his Pastor was not able to be here. Mr. Flynn said they are looking at different properties including this one that was previously occupied by Gateway. He said the use would be the same use as before…a church function. He said the reason they were coming was to ask if the Town had any issues with that building. He said they haven’t talked with the landlord yet.

Mr. Flynn was told that the Fire Department, for one, has significant issues with the building. It is an unfinished building; has no fire protection. Following information was provided to Mr. Flynn:
Glen Harrington
- Well is on the property; no town water goes direct to the building.
- Under State Drinking Water Act, radius of the well does not fully entail for full use of the building.
- Septic 1600 gallons/day.
- Use of the building was for one day only for Sunday and only for the church. Use limited to the first floor; can’t use second floor.
- Use extremely limited…any more than that they have to bring town water to building.
- Originally designed for retail.
George Baker
- Building was never finished.
- They leased out basement with garage doors.
- You had a church with assembly occupancy with industrial occupancy underneath—that is not allowed.
- Unfinished attic with access from first floor that was not controlled.
- Second Floor was constantly used—that violated use.
- Be careful with what agreements are done for the second floor. Second floor is an unfinished attic that shouldn’t be used. There are significant restrictions.
- Chief Baker said he would be happy to walk through the site with Mr. Flynn and the Pastor if they wanted.
- Assembly use and mercantile use requirements are extremely different.
The committee advised that the building code that existed when the building was built is not the same code today. Mr. Flynn said they were looking to lease here for a short term. Walter Yarosh said the owner of the building would have to come to Town Hall to get approval for you to lease. Walter suggested that perhaps the first step is for them to probably get some professional to go through the building and do analysis of use and codes.
Comments…Elevator hoist, but no elevator; no fire protection; building was never finished…leased, but never finished. Nothing in the code allows Sunday usage occupancy.
